Pressure Washer Stolen!

I tried a lot of times last nite to respond but kept getting an error stating that my response needs to be more than 5 characters, I was typing a lot more than that.


I have had that happen before also.
 
I have been going through the yellow pages calling attorneys, seems like they all are personal injury, bankruptcy, defence or immigration.

I will keep on calling.

Go pay the court 125 bucks file ageist him. He will have to answer the court, publicly Explain why he feels he is not responsible. He will not want to do this, GET IT!!!!


Personally I do not think you need a Lawyer.... I cannot see a Judge nor Jury Siding with him. He took custodial Care, never had you sign a Waiver.

Go to his Shop talk with him one more Time, record it be nice to him and make sure there are not visible Signs telling Patrons they will not be responsible for property left.

If you cannot Fly me there and I will do it....FREE for the cost of Flight and Hotel.

If you file a Claim he will have 21 days to respond.... If he fails to respond the court awards you the money. You call the sheriff and start drawing it out of his Cash register.

He will have to hire a Lawyer to win, the Lawyer will cost him 3000 to 5000 retainer. The lawyer if honest will advise him to pay you....

Chris unless you leaving out something like you signed a paper releasing him? I just cannot see a person in any court awarding in there Favor.
 
I did see a sign that states not responsible for things left over 30 days, the rig was there for a matter of months but the lady called me and reminded me like a week more or less before it got stolen so I don't think that the 30 day stuff applies as it was still there when she called and it was stolen within 30 days of her calling me.

I will call the court to see what the limit is for small claims is, I think it is limited to about $2500 or less.

The owner is never there, always out of the office or I would go there in person and record the conversation. I did try to talk to him on the phone but after we were arguing and it was not going anywhere I just hanged up.
 
Nice, claiming he is responsible until he wants to sell it after 30 days. Chris its so important you document these details. The day you dropped it, as of right now they could just claim you never left it. YEAH, you never got a receipt. I might have offered to pay him for fixing it. Second please start looking at you might just Claim 2500 to keep it so you can take him to court. I think its 5000

I will call the county courthouse tomorrow and see what the small claims court limit is.
 
Chris, I looked it up. Small claims has a limit not to exceed $10,000.00 in Texas. But check with you county to be sure. But if you win Small Claims Court it just means you have won the right of judgement. That means you have a judgement against him and it can be attached to some property so when he sells it the judgement has to be fulfilled. This needs to be renewed periodically, ten years I think. Going to SCC doesnt mean you going to get paid or restored. This guy may be judgement proof, as in no assets to attach to. My recommendation would be Lawyer up asap.

Just for clarity you need to document it all, write it down. And you dont need to answer this publicly. This time line probably will document your case into your favor. How long did they have your skid? When was it ready? When did they notify you it was ready? How long from the time of notification did you attempt to pick up? Did you contact them during this time? Did it exceed the 30 day time line from when they told you it was ready and the time you went to pickup? Did you have any communication in that time frame?
