He may be guilty of manslaughter depending on what the defense comes up with as far him feeling threatened with further assault or maybe he forgot who actually had the gun? Stuff like this happens fast.

I just wouldn't vote for guilty, period. Right or wrong it's called "jury nullification". Hey OJ used it to get away with 2 murders.
 
I live with in a mile from this Pharmacy and this case is really getting allot of attention around here. Oklahoma has a law it's called "stand your ground" I'll bet he will walk based on that law. The local news is saying that the DA's office has been ran over with phone calls in protest of them filing charges against the Pharmacist. Three other people were charged in the murder of this boy it seems as though some adults talked him into going in and trying to rob the place, sad to say the least.
 
He will be found guilty of manslaughter.The premeditated thing won't fly because he didn't plan to shoot the guy that day.They came to him and tried to rob him.The going back and shooting him again was harsh but I can't judge the man because I wasn't the one getting robbed at gunpoint.The robbers chose to put themselves in the position not the store owner.Justice was served.The only fault I find is the obne with the gun got away.Now that is an injustice.

Was the dude an MD? How did he know this crack head wouldnt get back up to finish his "job"? If he was still breathing he was a threat.

Ok.... I mominate you as part of his defense team..... I think you could really be a help in the court. LOL....seriously, I hope the jury is able to see it this way.
Who really knows....the dude could have been laying there shouting threats, reaching for a knife or a gun.....we were not there....I am just glad no one else got hurt. And hope the other guy ran off the road and hit a tree on the way home.

Oklahoma State law says a person must have "reasonable fear of imminent peril." Only then does that person have the right to "stand his or her ground and meet force with force, including deadly force, if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm...

I have a deal with sharks, if a shark shows-up at my house, I will kill him/her. If a shark see me swimming in his "house", I expect to be a shark snack.

If I was stupid enough to do an armed robbery, I would be the last one crying foul if I was shot or killed in the act of an armed robbery, whether or not I was armed.

The person that was shoot was 16 years old. There have been many mixed reviews on the local news. They have dropped the charges from murder 1 to manslaughter. It was on the news that the Judge has had death threats,because she allowed the man to bale out. It all happened in a not so good part of town. The business has a buzzer system to get in and out. When a customer went out they put a board in the door so they could get out. They had put some thought in to this . If they would only use that to get a job or be in school. His buddy thapharmacistt ended up getting caught was also a teenager. I'm not too worried abut the pharmacist, he has the BEST Lawyer in town.

Heard 1st degree murder charges dropped !
