Guilty Of Murder In The First Degree ?

I voted Guilty of Murder in the first degree :eek:
I agree with shooting the Armed Robber :D
But to come back when the Robber is on the floor, shot in the head, is going to be a BIG Problem for the Defendant in this Case :(
I think the QUESTION will be, "Was the robber already DEAD from the first shot" or not ?
If the robber was dead already, the shooting will be justified.
If he was dying, then the Law says it is first degree murder to intentionally go re load or get a Gun, and come back and kill him.
Getting the gun, and returning to finish him off is called premeditation.
The AUTOPSY will be key in this case !
Lets HOPE the robber was already dead, or the Defendant in this case is gonna get convicted!
IF I was the defense attorney, i woukld be getting my OWN Autopsy showing the robber was dead from the FIRST Shot :eek:
 
I read earlier the coroner said the "kill shot" was when he came back, that's not to say the head shot wouldn't have eventually killed him. I say NOT GUILTY based on my own personal beliefs, but most likely guilty according fact of law. Its like drawing a gun on a cop, no matter if you are justified or not, you just can't win. If a criminal draws a gun on you, then in my opinion, you are justified in any response you take.
 
Not guilty of murder......it was self defense of himself and the others in the store......there is no way he should be charged with murder.
Now, should be be in some type of trouble for the events after the first shot,,,yeah maybe but he should not be charged with murder.
If the thug would not have been in the store being a part of an ARMED robbery then he would not have gotten shot.
I think if his family pushes for the pharmacist to be charged and is found not guilty, then they should be counter sued for his time loss at work, as well as payment to cover the clean up of the crime scene as well as for the money lost due to the store being closed as a result of their thug son!!!
Just my personal opinion.

Again,,,,no murder charge but yes maybe a slap on the wrist or some type of punishment for his actions after the initial shot!

No one really knows how you will react in a situation until you experience it!
 
They should make it a law that if you are sued and you win for whatever reason then the court keeps on with the countersuit but at no expense to you whatsoever and make them pay and if they don't have money then sell everything they own to pay you, I think that would be fair.

Too much of this crap happening and it needs to stop now. If these crooks and theives want to live that life then they deserve to be shot for trying to take something that is not theirs and harming innocent people.
 
I was a witness to a guy fighting with the cops here in town. The thug DIED and his family is saying it was due to a tazor and police brutality..I have been questioned several times by the defendants (city) attorney on what I saw....The ABI also questioned me and informed me that the police were in no wrong and what killed the thug was him swallowing cocaine as he was running away from the police!!!
I informed the attorney that I would be interested in a civic suit or whatever we could come up with against his family for my time loss from my work and my family to deal with this crap that was a result of their thug son (who had already been locked up before for drugs).

I have no sympathy for thugs,,,,,,my wife was rob at a bank while she was working as a teller while she was in college..........So yeah I am glad for the pharmacist and glad he was on the right end of the gun!!!!! Our justice system is not hard enough on criminals..... Always trying to punish the one that were doing right to start with.
Hell the pharmacist was at WORK,,,,,,the thug,,,,,out riding around smoking dope with a thug buddy and downing a liter of some cheap wine!!!
Maybe if he had a job he would not have gotten himself shot!!!!!
 
Maybe we need to adopt some Middle-East methods of punishment like when they steal, cut their hand off. Commit adultery, cut something else off, etc... Maybe that would deter some of the thugs, crackheads and general dumba**es. At least they would suffer some for their crimes instead of doing some easy time behind bars.

The only prob with cutting off their hands here in America is we would end up paying them disability for the rest of their lives......
 
He will be found guilty of manslaughter.The premeditated thing won't fly because he didn't plan to shoot the guy that day.They came to him and tried to rob him.The going back and shooting him again was harsh but I can't judge the man because I wasn't the one getting robbed at gunpoint.The robbers chose to put themselves in the position not the store owner.Justice was served.The only fault I find is the obne with the gun got away.Now that is an injustice.
 
That is true, the system would have to be changed to not allow any benefits if you are penalized for a crime and no disability. There is no disability benefits over there so some things would have to be similar for it to work.

Maybe enough of this type of a system might deter some of the crimes if people started seeing their friends "Punished" Middle-East style.

He did plan to shoot the guy :)

The guy was lying there dead, or dying.
That part was self defense.
But when he made a decision to go BACK and shoot him some more, that can be considered premeditation, under the Law.
I don't blame him for what he did BTW.
But I think he is going to go down for it :(
 
Dead is Dead, he just wanted to save the tax payers some money. So if he survived he would have got free medical and room and board for about 10 years then released on good behavior.

Then he would have gone out and maybe killed some one from your family, and we all would have wished he had a 19 rd clip!!!

It is a know fact that dead men dont get parole!!! these criminals dont get rehabilitated they just sit around waiting to get out and target their next victim. I say we should give the man a Parade and a Key to the city.

NOT that I support the charges against the man who shot the robber, I don't!
But a Jury will find it hard to believe an unarmed man with a shot to the head, lying on the ground was going to finish anything, except his own life :(
I agree with Nick that he saved the taxpayers lots of money!
 
If he gets a bunch Obama supporters on a jury he's dead meat. If he gets some Ricks', Nick's, Terry's, Chris and Roger's, we'll all go drink beer and eat BBQ with him after he's aquitted.

Looked like he was reaching for a weapon to me.
 
If I were on the jury I'd vote not guilty.

The punk placed himself in the position to be killed.

Fear, panic, and adrenaline pushed the man too far.
But he is not guilty in my eyes.

Did you notice what both punks did when they knew the man had self protection??
They cut and ran.......... at least one of them.
