Actually, he's put the government in a catch 22.

a) the government admits corporations aren't "persons" and the world crumbles down around them (because corporations survive due to their "personhood"), or
b) the government confirms that corporations are "persons" and that anyone with a corporation can drive in the POV lane unimpeded

Another option they have is to show their true colors and rule against him regardless of what the "law" says.
