Just In... Parker West in California apparently is sueing CUA

Apparently I have received the actual Court Complaint by email. It states that the polymers used in the filtration units that is sold as a package must be bought through Parker West for cost plus a 20% mark up. Also other fees that is associated with the 100k package. Apparently Parker West designed and makes the whole unit and sells them to CUA. Steel Eagle is also mentioned in the papers. This is big folks... hold on for the ride !!!:eek:

Parker West claim against Clean Up America

Hello everyone -

I just want everyone to understand the premise of our claim against CUA. Our patent is for a MOBILE apparatus that includes a pressure washer/steam cleaning unit, vacuum recovery equipment in fluid combination with a wash water treatment system that utilizes CLAY based flocculates to treat, recycle and reuse the wash water generated by pressure washing/steam cleaning activities, wherease the equipment is mounted on a 'WHEELED CONTAINER".

The reason we chose to patent this clay based wash water treatment technology in 1996 is because it is a simple, one step process that removes oil, grease and metals whether the contaminates are in solution or not. In other words the wash water treatment works even if you use degreasers. Also, the contaminates removed from the washwater become immediately and permenantly locked within the formula, rendering a non leachable, non hazardous solid waste.

Oil/Water Separators do not work if the contaminates are in solution and they do not remove metals....and the solid waste is not encapsulated and are hazardous.

It is the simplicity, the speed, efficiency of this waste water treatment method and the compact size of the equipment that makes it so appealing for mobilization.

CUA's patent includes a conventional mechanical OIL WATER SEPARATOR,, not the use of clay based flocculates. Oil water separators do not work well when cleaning large surfaces like parking structures and lots for removing coatings. The filters blind very quickly, causing alot of down time and maintenance. If CUA was using an oil/water separator, we would not have a claim against them.

CUA obtained a NON EXCLUSIVE license to use of the PW technology in 2003 However, we terminated our agreement with them, due to lack any payment of the monies owed for the licensing agreement with PW. They do not have permission to use the Parker West patented technology.
 
Is this technology available for us smaller companies to buy or use for when we need to process the waste water like parking garages?

Since I do not know much about this patented technology, would some company like me be able to purchase some of the flocculant for my work or do you need a license or agreement?

We had the funeral the other day and it went good. My brother is doing a little better but it is very hard for him right now coming home to an empty house after living together for 12 years with his wife and daughter. A very bad tragedy.

It will take time to heal the pain but we are all there for him.

The above email came directly from the lawyer to me after I spoke to him last night.

I got the email from ( warren_dranit@live.com ) I also talked to Parker west about a week ago and he was not happy with CUA at that time. Also the attachments look authentic. In the above email to Beth, he dose not say that there is no law suit... he just says the emails was not sent by him. If this is a Joke, it was well thought out. The language in the attachments, the professional legalese wording of those attachments and Parker West expression his apparent concerns about the "falling out" of the written agreement.

I think someone got a hold of these doc's. and emailed them to a select few knowing that it would get out nationally. Bad news travels fast.

It just played itself out over time. Nothing ever really happened to any guys like myself who bought the system.
