I asked the same question on one of the other boards... I need a answer fast I was giong to start faxing 2morrow! is it against the law to fax ads?

I usually try to call them first. It only takes a second. I tell them what I do and ask them if it's ok to fax info and what their name is. I write it down in a log and from that point on, they are LEGAL.

If they are already customers it's legal. My wife has over 21,000 customers that I hit.

I still put an "opt out" number to call at the bottom. No one's ever called it yet.
 
Fax enough and you will get 'opt outs'.... As I implied on that other forum....do your homework first as it is complex and it matters where your at and there are rules. Jumping in tomorrow might not be best thing. Run the searches I suggested to find the info that most of us have checked into or confirmed.
 
Random faxing will get you busted for sure. Addressing the faxes to specific people is how we do it.

Random dialers (NO NO) and the time you fax is also important to stay out of trouble.

We only fax local during business hours.

Sorry but that is not exactly true folks as we been through this.

The creation of the legislation in first place was intended mainly for to protect residential people from business spam ads and overstepped what many businesses wanted in being able to still do business to business faxing. Has been a battle of amendments, exemptions, and revisions by both fed and state ever since it was created. The net is full of interpritations before the horse rounds the turn and many overstep the words in the legislation in an apparent agenda based discouraging.
What it comes down to usually is yer state rules would apply IF they are not contantly challenged and held up in court. Much outdated pages can be found on the net so beware.

But to get to the meat of my point... Firstly, note the word 'most' in the first sentance of the fcc link "most unsolicited facsimile (fax) advertisements." It is there for a reason and is meant on that page as a prelude to exceptions.

The word 'permission' sort of went unclear/undefined hence some additional ammending is my interprit. 'Expressed INVITATION' now belongs and when it comes to business to business faxing it becomes apparent that most any method of your obtaining their fax number in the first place makes for an invitation since it was published as contact info. When fax number is in a mailing list or on a businesses web page, or published, etc. they are basically holding theirself out as doing business and offer invite.

You have to follow fed rules and whatever state rules that might apply to you. Some states can fax other states based on their fed and state laws being followed but they are not necessarily following the state laws of where they fax to because they don't have to.
When I fax I have permission as the numbers were published and I cross them to a do not fax list maintained by the government so that my info of such status is not considered outdated. I am also set up with the obvious opt out language required.
 
You want to make sure and check your state laws. Most that get in trouble for it ignore the "opt out" requests. Like everything else it's mostly a common sense thing. The attached link is about a pump and dump stock outfit that will probably go no where. It took 1,842 complaints before the state even tried to do anything.

Short article eh Rick?.. but does show something of how big or blatent things would have to tend to be before action is even attempted. Note the words 'could be fined' and that we know not how that will end. Also note how it mentions 'consumer' and 'unsolicited' and probably is all about residential random faxing.

There is a way to fax legit, please understand that again. Random dialers and faxing during illegal hours will get the FCC knocking on door. It will actually come from your local Phone provider.

LOL, Thats actually where you can get your info. Start with your local phone company about the do and dont's.

It can be done legal, you just need to follow the grey lines to make it work for you.
 
One way I have found to get fax numbers is to first find the names and phone number of potential customers. Then I call them up, I tell them who I am and state that I do not want to take up their time right now but ask if there is an e-mail or fax number that I can send them some info and discount offer to? You might entice them with a free offer or service if they agree. Be sure to take down the person’s name that is giving you the info in case later someone in that company comes back that you did not have the permission. Keep good records with the business you are calling the info you have and then receive and how and when you use it in the future. I try and not send to the same fax more than once every 90 days. This way my name and service can be remembered but does not become a nescience contact.

I always enjoy hearing stories of cops raiding someone elses house besides mine...Hey it was a long time ago!!! It only happened twice. Ok! Ok! 3 times but it was still along time ago. :D Ron give me a buzz tomorrow if you want.( Not at 5:45 am either LOL...) I don't know why but this seems like it may be an interesting and funny story. :)

No raids larry, was joking. Just received letters about the sistuation and gave answer to resolve it. This is why everyone should talk with your local carrier to get the proper instructions.

If you are operating incorrectly they will be first contacted to ask questions.
